Everyone knows the story about the woman who burned her legs due to hot coffee from one of the biggest fast food chains in the world. Let’s just say that the caution warnings on coffee cups are not simply a preventative measure that was taken before an incident ever occurred.

In this particular case, the victim spilled coffee on her leg and groin area after placing an order in a drive-through. The burns were severe and required skin grafting.


According to the Texas Trial Lawyers Association, the fast-food chain acknowledged that it had known about the potential hazard of serious burns from its scalding hot coffee for more than a decade . The risk was brought to the chains attention through numerous other claims and suits.”

Once the lawsuit was underway, it was discovered that the temperature of the cup of coffee was, in fact, burning hot and unsafe to serve to customers. The victim, whose physician ended up testifying that her burns were some of the worst scald burns he had ever seen, originally sought damages for $20,000, the cost of her treatment, and was only offered a skimpy $800.00 by the fast-food behemoth.

This was unacceptable to the burn victim and her attorney. The victim ended up taking the entire chain to court and was awarded $2.7 million in punitive damages.

Scary Statistics

Halloween is scary, but not for the reasons that you might think. According to the U.S. Department of Transportation on Halloween night 2016: 

  • 47 people died and nearly a third were due to drunk drivers – three times the fatalities of an average day.
  • Thirty percent of Halloween crash fatalities were pedestrians, compared to only 16 percent on an average day.
  • Over the last four years, from 2012-2016, 22 percent of pedestrian fatalities on Halloween night involved a drunk driver.

Halloween PumpkinsSafety experts at Monroe Carell Jr. Children’s Hospital at Vanderbilt warn that “twice as many children are killed while walking on Halloween than on any other day of the year”. According to research conducted by Sperling’s BestPlaces, over 60% of these accidents occur in the 4-hour period from 5:00 to 9:00 p.m.

Aside from motor vehicle accidents and pedestrian accidents, typical Halloween injuries include slip and falls, costume-related accidents and injuries and burns from candles and candlelit pumpkins.
